This Indenture, made the 14h day of December 1849, between William A Hart of the first part, James W Mason of the  second part, and Zachariah R Lewis of the third part, and all of the County of Albemarle and state of Virginia. Witnesseth, that William A Hart, of the first part for and in consideration of the premises as well as the sum of one Dollar to him in hand paid, by the said James W Mason at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged hath given, granted bargained & sold unto the said James W Mason, the following negroes, viz, Margaretta & her five children, named as follows, Edward, Maria, Charles, Malvina and Fanny. To have and to hold the above named negroes unto him, the said named James W Mason his heirs and executors and Administrators & assigns forever, and that free and clear of all claims and encumbrances Whatever. In trust, nevertheless, and upon the following conditions viz. that whereas the said William A Hart is justly indebted to the said Zachariah R Lewis in the sum of twelve hundred dollars, by bond dated the 14h December 1849 and payable twelve months after date, with interest thereon from the date of said bond, and also in the further sum of twelve hundred dollars by bond dated the 14h December 1849 & payable two years after date _ with interest thereon from the date of said bond, which several sums it is the intention of this Indenture to secure. Now therefore it is  understood and agreed that if the said William A Hart shall fail to pay the said several sums, with the interest accruing on them, on or before the 14h day of December 1851, that then the said James W Mason shall thereupon or so soon thereafter as required by the said Zachariah R Lewis, his heirs, Exers, Admrs or assigns, proceed to sell at public auction, to the highest bidder before the Eagle Tavern, in the town of Charlottesville, and County of Albemarle, or at any other place the  said Zachariah R Lewis and William D Hart may agree upon, for ready cash, the property hereby conveyed having previously advertised the time and place of such sale for one month at least, at some public place in the said town of Scottsville, Albemarle County, and out of the proceeds thereof, having first defrayed the expenses of recording and executing this deed of Trust, shall pay to the said Zachariah R Lewis the said sums of money_ together with all Interest which may accrue, and the balance, if any shall pay to the said William A Hart, his heirs, Exrs, Admrs or assigns. Nevertheless should the said William A Hart make no default in the payment of the said sums of money, but fully pay off & discharge the same on or before the said 14h day of December 1851 then this Indenture to be void, otherwise to remain in full force and virtue. Albemarle County to wit. We John Tyler and M Blair Justices of the peace for County of Albemarle in the state of Virginia, do hereby Certify that William A Hart, party to a deed dated 14h December 1849 and hereto annexed personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed, and desired us to certify said acknowledgement to the Clerk of the County Court of Albemarle, in order that the same may be recorded.
