In the name of God amen I Robert McCullock of the County of Albemarle and State of Virginia thru mercy of sound mind and disposing memory do make and ordain this my last will and testament in manner and form following that is to say 1st my my will is that all my just debts and funeral expenses be paid out of the personal part of my estate 2dly I lend unto my beloved wife Sarah McCullock during her natural life Eleven negroes (to wit) Charles, Willis, Nanny, Milley, Lucy, Nicholas, Garrett, Sophia, Moore, Roland, and Dennis, and also the further Increase of Milly and Rebecca, whatsoever it may be previous to her decease and my dwelling house and also the use and priviledge of cultivating any part of My land hereafter devised to my son James except his joint interest in the Brick Griss mill and saw mill. also I give unto my beloved wife my griss mill on the waters of Buckmountaing and also all the land more or les adjoining said Mill and also two thirds of all my stock of horses, Cattle Sheep and Hogs to her her heirs and assigns forever the same to enjoy and dispose of as she may think best, except the above named eleven negroes and the future increase of Milly and Rebecca which I only lend her for her life. 3dly I give unto my daughter Mary three negroes to wit, Kiziah, Fillis, and Matthew and their increase to her her heirs and assigns forever 4thly I give unto my son Thomas McCullock my land lying on doyles river the south west side and two negroes to wit, Sampson and Lewis to him his heirs and assigns forever. 5thly I give unto my son John McCullock my land lying on Doyle river on the north east side of doils river and three negroes to wit, Aaron Billy and Roze and her increase to him his heirs and assigns forever 6thly I give unto my son Robert McCullock the upper part of my land I now live heretofore deeded to to him also a joint and equal right title and interest with my son James McCullock in and to Brick mill and saw mill on Mourmans river including the mill race and the Land lying between said rase and the river. also two negroes to wit, Moody and Demaris to him his heirs and assigns forever. 7thly I give unto my son James McCullock all the other part of the tract of land I now live on on Mormans river up to said Joining line heretofore deeded to my son Robert McCullock. Excepting my brick Griss mill and saw mill and the mill race and the land between said rase and river and with this provision that he shall and it is to have a joint and equal right title and inheritance in to said Mill race &c with my said son Robert McCullock as also three negroes to wit, Robert, Betina and, Milly and their increase after the death of my wife also a Horse and saddle, and one third part of all my stock of Horses Cattle Sheep and Hogs to him his heirs and assigns 8ly I Give unto my Grand Son Thomas Turke McCullock one negro man named Phillip one bed and furniture one Clay colored horse and the saddle he commonly rides and my smooth board gun, to him his heirs and assigns forever which possession is and shall not be till my wife’s decease and also I Give unto him one fourth part of my churrock mill which is my right and title in said Mill 9thly I my will is and I give unto my wife all my household and kitchen furniture to enjoy, and dispose at her own option and discretion and all my plantation tools and also my smiths tools I give unto my son James McCullock 10thly my will is and positively order and direct that no persons or person shall have any control to or over my negro man Phillep above devised to my Grandson Thomas Turk McCullock except my wife Sarah McCullock till after her decease 10thly all the residue of my estate of whatsoever name or nature not heretofore devised shall and is to be equally divided among my five children above named and I do hereby constitute and appoint my sons Thomas and Robert McCullock Executors of this my last will and testament hereby revoking all other or former wills or testaments by me heretofore made. And lastly being desirous to prevent any disputes among my said distributees in the foregoing gives mentioned my will is that in the event of  their being dissatisfyed with the distribution my Executors before named shall make under the above devises that the Court of Albemarle will please to appoint three or more discreet and fit persons to here and decide the matter or matters in controversy and that their award shall be entered of record in said Court and shall stand valid and good both in law and equity In Witness whereof I have set my hand and seal this thirteenth day of December in the year of our Lord eighteen hundred and nineteen. At a Court held for Albemarle County the 1st day of May 1820 This Instrument of writing purporting to be the last will and testament of Robert McCullock deceased was produced into Court and proved by the oaths of Fountain D.
