Deed Sally Carter to James Ross 1809

This Indenture made the Twenty Seventh day of December in the year of our Lord One Thousand Eighty Hundred and nine Between Salley after of the first part and James Ross of the second part Whereas Edward Carter Deceased late of the Town of Fredericksburg did by his Testament & Last Will among other things Devised to his wife Sally Carter During her life or widowhood his plantation and house in the county of Albemarle Known by the Name of Blenheim as also his plantation in the said County Whereon his negro Stepney lived & acted as said Overseer and after her Death or widowhood he gave the said Two Tracts or parcels of land to his son William Champe Carter and his heirs as by his will now of record in the County court of Spotsylvania will more fully appear. and whereas the said James Ross is now entitled to the reversion on the said Lands so Devised to the said William Champe Carter by a conveyance made to him by said William Champe Carter Maria his wife, others & Edward Carter Howard duly recorded in the County court of Albemarle and has purchased the life Estate of the said Sally Carter in the same and She has agreed to Surrender the same to him. Now this Indenture witnesseth that the said Salley Carter for and in consideration of the sum of One Dollar to her in hand paid by the same James Ross before the ensealing & Delivery of these presents the receipt whereof is hereby acknowledged hath given granted bargained & Sold released Surrendered and by these presents doth give grant bargain Sell Surrender to the said James Ross all her life Estate right title & Interest In and to the said Tracts or parcels of Land aforesaid Devised to her as aforesaid for her life or widowhood and after her Death Devised to said William Champe Carter together with all houses buildings Orchards Ways Waters & water courses profits commodities hereditaments & appurtenances whatsoever to the said Tracts or parcels of Land belonging or in any way appertaining & the reversion and reversions remainder & remainder rents Issues and profits thereof and of every part & parcel thereof. To Have and to Hold the said Tracts or parcels of land & all and Singular the appurtenances thereto belonging or in any ways Appertaining to him the said James Ross his heirs & assigns for and During the life or widowhood of the said Sally Carter to the only proper use & behoof of him the said James Ross his heirs &assigns for & During the life & widowhood of saidSally Carter; And the said Salley Carter for herself her heirs Executors and administrators Doth covenant promise & agree with the said James Ross his heirs & assigns then she the said Sally Carter the said Tracts or parcels of Land with all Singular the appurtenances for & During her life or widowhood to him the said James Ross & his heirs &assigns against the claim & Demand  of her the sd. Sally Carter and her heirs and against the claim and demand of all and every person or persons whatsoever Shall & will warrant and forever Defend by these presents In Witness whereof the said Sally Carter hath hereunto Set her hand and Seal the Day & year first above written.

Hastings court of Frederickburg January the 11th 1810

This Deed from Sally Carter to James Ross for lands lying in the county of Albemarle was proved by the oaths of the three witnesses thereto and ordered to be certified to the court of said county to be recorded. Teste Robert S Chew C. C. H. F.

Spotsylvanie County court January 4th 1813

This Deed from Sally Carter to James Ross for lands being in the county of Albemarle was was proved by the oaths of Henry Rice Viominil Carter & Garret Minor three witness thereto and Ordered to be certified to the court of said county to be recorded. Teste Robert S. Chew C.S.C.

At a court held for Albemarle county the 1st of February 1813.

This Indenture of Bargain & Sale between Sally Carter of the one part & James Ross of the other part was produced unto court and Duly certified from the county court of Spotsylvania and ordered to be recorded. Teste John Nicholas C.S.C.
