This Deed made the 7th day of October 1852 between Samuel Ward & Mildred, his wife, of the County of Albemarle and State of Virginia, of the first part, and N. H. Massie, of the same County and state of other part. Witnesseth, That the said Samuel & Mildred, his wife, do grant unto the said N. H. Massie, the following property tract, a tenet of land lying and being in the County of Albemarle and State aforesaid on the lower side of the Buck Mountain road, containing 350 acres, be the same more or less, being the same land willed by Henry Ward to the said Samuel Ward, and upon which the said Samuel now resides, adjoining the lands of William Ward, Brightberry B. Garth, Elizabeth Ward & others, also one negro man about 18 years old named Austin, one negro boy about 16 years old name Albert, one negro girl about 14 years old named Sina, and one negro boy about 10 years old named Scott, one negro man about 35 years old  named Jacob, and one negro boy about 15 years old named Andy. In trust to secure the following debts, trust or bond due to John J. Pace, bearing ever date with this deed, for two thousand seven hundred and ninety five dollars, & 96 cents payable on demand with interest from date, a bond due John J. Pace, of the same date for three hundred and ninety one dollars and 81 cents, payable ten months after date, with interest from date, a debt due Pace & Jarman on open account amounting to something between three & five hundred dollars, the exact amount not known, and a debt due by bond to John N Gillum for some where about one thousand dollars & neither the amount nor date being remembered exactly, all which debts are due by the said Samuel Ward, and the true payment of which he is certain to secure, it being understood and agreed that the debts due by bond to John J. Pace individually are first to be paid then the debt due Pace & Jarman, and after satisfying them, lastly the debt due John Gillum, and upon the further understanding that the said Samuel Ward is to be left in the quiet use & possession of all the above described land & negroes, until such time as the Trustee may be required by the parties under the provisions of this deed close it for the purpose of liquidating the debts hereby secured. It is also further agreed by and between the several parties hereto, that the said trustee shall, at any time after thirty days notice to the grantor Samuel Ward, and upon the request of the said Ward or any one of the said creditors herein secured, after giving reasonable notice thereof by publication in the newspapers and otherwise proceed to sell to the highest bidder for cash the above described land and negroes, and out of the proceeds thereof, after deducting the necessary expenses of the trust, shall pay to the said John J Pace the amounts herein before described as due to him, principal and interest, then to Pace and Jarman the debt due them with its legal interest, and the debt due John N. Gillum with its interest and shall then pay over the residue, if any there be, to the said Samuel Ward, his heirs, exers or assigns. This day personally appeared before us Giles B. Rogers & K. G. Crank, Justices of the peace for said County, Mildred Ward, wife of Samuel Ward, a party to the foregoing deed, and  being by us examined privately and apart from her husband and having the provisions fully explained to her, stated that it was her act and deed and that she wished not to retract it,

This Deed was presented to me in my said Office, and being acknowledged by Saml Ward, was thereupon, together with the relinquishment of dower of M Ward thereto returned, admitted to record.
